Many founders believe a business’s success is measured only in sales volume, smooth logistics and successful imports. But the reality is that you can have the most profitable e-commerce operation in the country and be left with nothing overnight if you are building your brand on rented ground.
A real case
Not long ago, a telling case came to my office: a company that imported products from China and had built a successful sales channel on Mercado Libre saw that digital channel blocked completely because a third party registered its name first. Years of effort and advertising investment lost through a legal oversight.
To me, registering a trademark is not a secondary bureaucratic step: it is the foundation of any asset meant to hold real value over time. If you do not own your identity, your business is extremely vulnerable.
How Mercado Libre acts
Mercado Libre, Latin America’s largest online marketplace, has a strict intellectual property protection system, the Brand Protection Program, which constantly audits the ownership of products and trade names. If a third party proves it holds the official registration of the trademark being used, the platform suspends the listings and immediately blocks sales by anyone using it without a registration.
What is at stake
- Penalties and removed listings: a complaint from a registered owner can pause the store or shut it down, and it damages your seller reputation.
- Loss of ranking: years of investment in metrics, reviews and accumulated sales are disabled in minutes.
- Risk of financial claims: whoever holds the formal registration can sue for unauthorized use and for damages.
To operate, scale and protect revenue in e-commerce, holding the ownership title granted by INPI, Argentina’s trademark office, is not optional: it is the legal requirement that guarantees business continuity.
At Synowiec & Asociados we structure the defense of trademark portfolios and have the tools needed to ensure our clients’ intangible assets are properly protected.
